Amendments Related to the Turkish Civil Aviation Law Accepted by the General Assembly of the Turkish Grand National Assembly
PERMISSION WILL BE GRANTED FOR FACILITIES TO MEET THE NEEDS OF PASSENGERS AT AIRPORTS
With the new law, facilities such as health centers, hotels, motels, restaurants, religious facilities, and shopping units to meet the essential needs of passengers at airports will be permitted. In addition, fuel stations, logistics cargo facilities, management and administrative buildings, temporary accommodation facilities, and terminal buildings will also be allowed. These facilities can operate as long as they remain within the airport boundaries. Additionally, permissions will be granted for railways and related facilities to be constructed by the General Directorate of Turkish State Railways (TCDD).
INTERNATIONAL INSPECTIONS AND CERTIFICATION REGULATIONS
With the new regulation, inspectors from the International Civil Aviation Organization will be authorized to conduct inspections and reviews, and the certification of international airports will be regulated. Furthermore, all domestic and foreign individuals engaged in civil aviation activities within or outside the country will be subject to inspection and review by the Directorate General of Civil Aviation.
PASSENGERS CAN BE SEARCHED WITHOUT PERMISSION
To ensure security at airports, individuals with access to confidential information and those who could gain unauthorized access to airport security areas will be subject to security checks. Private security officers, based on a written order from the airport administrative officer, can check the persons they suspect, their luggage, and their belongings using technical devices or, if necessary, by hand under police supervision. Prohibited items will be confiscated and subject to judicial search in accordance with the Criminal Procedure Code.
STRUCTURES THAT COULD RISK AIRPORT SECURITY ARE PROHIBITED
Structures around airports that could obstruct air traffic or navigation aid devices and endanger aviation safety will be prohibited. The Ministry of Transport and Infrastructure can intervene through local administrative authorities to remove structures that pose a threat.
HEAVY PENALTIES FOR NON-COMPLIANCE WITH CIVIL AVIATION RULES
Penalties have been increased for commercial air operators who fail to obtain the necessary permits, fail to report changes in tariffs, or fail to register Turkish civil aircraft. Accordingly, fines that previously started from 500 liras have been increased to between 10,000 and 500,000 liras with the new regulation. Those who do not comply with the regulations of the Directorate General of Civil Aviation will also face fines of up to 500,000 liras.
