Details of the Violations
The DOT found that Lufthansa flew in restricted U.S. airspace between March 2022 and April 2024, while Swiss operated in the same airspace between February 2022 and March 2024. These flights took place in areas prohibited by the Federal Aviation Administration (FAA) for U.S. operators.
Investigations revealed that both airlines violated the regulations set by the FAA and DOT. It was discovered that, despite FAA restrictions, both airlines operated flights using United Airlines’ flight codes without obtaining the necessary permissions.
Reasons for the Fines
According to U.S. regulations, U.S. operators and other airlines carrying their flight codes must obtain special authorization from the FAA when flying in restricted airspace. Lufthansa and Swiss were penalized for flying in such airspace without permission, violating the integrity of U.S. airspace.
Both airlines were instructed to cease such operations in the future and comply fully with FAA and DOT guidelines.
U.S. Airspace Safety and Regulations
The fines imposed by the DOT are considered part of efforts to protect U.S. airspace safety. Investigations conducted by the DOT’s Office of Aviation Consumer Protection (OACP) reiterated the necessity for international airlines to comply with FAA regulations.
According to the DOT’s decision:
