The Moscow City Court ruled that Pobeda Airlines’ practice of forcing additional insurance services on passengers during online ticket purchases violates the law. This decision, stemming from a case filed by the Astrakhan Regional Rospotrebnadzor Directorate, is seen as a precedent in the protection of consumer rights.
Automatic Insurance Checkbox Banned
Pobeda Airlines presented passengers with a pre-checked box for additional insurance services, requiring them to accept this service when purchasing tickets. Rospotrebnadzor argued that this practice was against consumer rights and initially brought the case to the Shcherbinskiy District Court. Although the case was dismissed in March 2023, the Moscow City Court reevaluated it upon appeal, ultimately ruling that the practice violated consumer rights and ordering its cessation.
Binding Court Decision: Mandatory Paid Services Prohibited
The court declared it unlawful for airline contracts to impose additional paid services on passengers, stating that extra charges cannot be added without prior consumer consent. This binding decision means Pobeda Airlines can no longer impose mandatory insurance services on passengers.
